Recent events have caused regulators and carriers to re-examine the types of information exchanged between carriers and the various consumer reporting agencies, including ChoicePoint. Regulators and carriers are likely to be surprised at what they find. Regulators may be compelled to regulate the flow and security of such information even more and carriers may be surprised to find inadequate procedures governing such uses of the information.
This panel will provide an update on the regulatory landscape in the area of privacy and security against the backdrop of Sarbanes-Oxley and related legislation. Topics addressed will include HIPAA, GLBA, FCRA, FACTA, and various state initiatives such as the California law requiring disclosures of security breaches. The discussion will cover an overview of the laws and practical pointers in the procurement process to obligate a carrier’s suppliers to maintain adequate privacy procedures and security safeguards.
